This Schedule applies to a recruitment agency, staffing agency, placement business or other organization representing employers, candidates or both.

S3.1. Legal status and mandates

- Hold all licences, registrations, insurance and authorizations required in each relevant market.

- Maintain a genuine and current mandate for every role or service and identify whether you represent the employer, candidate or both.

- Disclose material conflicts, commissions, subcontractors, exclusivity and limits of authority where relevant.

- Do not use an expired or speculative mandate to collect candidate data or advertise an opportunity.

S3.2. Candidate authority and fees

- Do not create, enrich or submit a candidate profile without informed authority and a lawful basis for the data transfer.

- Maintain evidence of the candidate’s authority, the source of the data, the intended recipients and material disclosures.

- Do not charge candidates unlawful recruitment fees or conceal fees, deductions, deposits, commissions or refund conditions.

- Do not submit the same candidate repeatedly or to an employer without permission and do not fabricate candidate interest or availability.

S3.3. Employer and job verification

- Verify the employer, mandate, genuineness, material terms and apparent legal feasibility before presenting a role.

- Do not continue advertising after the mandate expires or after learning that material conditions are false or unavailable.

- Promptly communicate a material change to affected candidates and permit withdrawal without retaliation.

S3.4. Records, data and subcontractors

- Maintain records of mandates, candidate authority, disclosures, communications, checks and fees for the lawful retention period.

- Use personal data only for the authorized placement or service purpose and apply access, security, deletion and incident controls.

- Remain responsible for subcontractors and independent recruiters you introduce or authorize. They may not use an agency account anonymously.

S3.5. No false affiliation

Do not present yourself as InquOS, a government authority, an employer, law firm or exclusive representative unless that status is documented and expressly authorized.
